The Government has published a consultation document announcing that the national default retirement age (DRA) of 65 is to be abolished next year. Under its proposals, no new retirement notices under the statutory procedure will be valid from 6 April 2011. Some 7% of people from ethnic minority backgrounds felt they had been refused a job for reasons of race, compared with just 1% of white people, reveals a new survey from the Communities and Local Government department. A higher proportion of people from ethnic minority backgrounds (5%) also felt they had experienced racial discrimination when seeking promotion, compared with 1% of white people.

The latest report from the Tribunals Service shows that there were sizeable increases in the number of discrimination cases brought relating to all types of discrimination except sex discrimination (down 2%). The Court of Appeal has ruled that employees between age 60 and 65 were not placed at a “particular disadvantage” by the introduction of a requirement that to be graded at the top grade for legal adviser, and to receive the higher salary linked to that grade, an employee had to have a law degree. The tribunal in this case gives a narrow interpretation of justification in direct age discrimination, holding that Article 6 of the Framework Employment Equality Directive requires a “legitimate aim” to have an element of public or social policy, and that purely private business aims are not sufficient. Although the respondent’s aim of ensuring a career route for officials with a mix of age and experience at senior levels was considered to meet that requirement, the tribunal found that retirement at 48 was not a proportionate means of achieving that aim. Despite manifesto commitments to scrap the default retirement age (DRA), the Conservative/Liberal Democrat coalition agreement states that it will now be phased out, although it is vague on the detail. The Labour Government were committed to reviewing the DRA, in order to make changes to the retirement age in 2011.
