It was a proud boast of the last Labour Government that it negotiated an opt-out for the UK from the Charter of Fundamental Rights of the European Union. The Charter is given legal force by the Lisbon Treaty, which came into effect on 1 December 2009.

I went to an interesting symposium organised by the Humanist Philosophers group on when it should be permissible to allow exemptions on grounds of religion or belief from legal requirements, an especially hot topic, of course, in view of cases like Ladele (see EOR 199) and McFarlane (see EOR 201).

How relevant is the religious background or sexual orientation of our judges? Lord Carey suggests in his witness statement in the McFarlane case that the Court of Appeal judges who decided Ladele and Eweida should no longer sit in similar cases because of their “lack of knowledge about the Christian faith”. Since, I am reliably informed, two of the three judges in Ladele and the lead judge in Eweida are of Jewish ethnicity, Lord Carey’s comment can be seen as having rather sinister undertones.
