The European Court of Justice has ruled that pregnant women who, for health reasons, are doing alternative work or who are suspended are not entitled to maintenance of allowances from their regular work which relate to the actual performance of those job duties. Direct sex discrimination against pregnant RAF officer

An RAF officer who was removed from her job and lost out on promotion prospects because she was pregnant is found to have been directly discriminated against. An employment tribunal rejected the RAF’s defences of “combat effectiveness” and health and safety. Employers concerned about new paternity rules

Some 82% of employers are concerned that the new additional paternity leave (APL) rules will have a negative impact on their companies, according to a new survey. Undertaken by law firm Davies Arnold Cooper, the online survey covers 97 companies across the UK.

More mothers staying in same job after childbirth

The proportion of mothers who changed employer upon returning to work after maternity leave has dropped from 41% in 2002 to 14% in 2007, according to a new report from the Department for Business, Innovation and Skills.

A respondent's failure to communicate with an employee, who was absent due to pregnancy and childbirth-related sickness, seems to be the underlying issue in this case. Although she alleged hostility toward her after she announced her pregnancy, her letter of resignation came after two months of silence from the respondent, broken only by a letter inviting her to a disciplinary hearing for gross misconduct. Day and evening shifts not left open for maternity returner

On return from maternity leave, an employee was not offered work on the same shifts that she was originally employed to cover, as the respondent had not planned for her return. Further, although the respondent had carried out a risk assessment, it had simply listed the potential risks to the pregnant employee without identifying the action to be taken. Failure to find work for pregnant agency worker was discrimination

An agency that failed to provide assignments for a pregnant employee was found to have discriminated on grounds of pregnancy. Even though it was recognised that the claimant could not insist on work being provided, the reason for the failure was pregnancy-related.
